1. Acceptance of Terms
These Terms & Conditions (“Terms”) govern your access to and use of the OneWeekPTE Platform and services (“Services”). By creating an account, purchasing a subscription, or using the Platform, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Platform.
2. About OneWeekPTE
OneWeekPTE provides online PTE preparation tools, including (but not limited to) practice questions, mock tests, AI-based feedback, analytics, and study resources designed to help users prepare for the Pearson Test of English (PTE).
OneWeekPTE is independent and not affiliated with, endorsed, or approved by Pearson, the official PTE test administrator. All third-party trademarks remain the property of their respective owners.
3. Eligibility
You must be at least 13 years old to use the Platform.
If you are under 18, you confirm that you have the consent of a parent or legal guardian and they accept these Terms on your behalf.
You agree to comply with all applicable laws in Australia and in your own country when using the Platform.
4. Accounts
To access certain features, you must create an account.
You agree to:
- Provide accurate and current information.
- Keep your login credentials confidential.
- Not share your account or login details with other people.
- Notify us immediately if you suspect unauthorised access to your account.
You are responsible for all activity that occurs under your account.
We may suspend or terminate accounts that we reasonably believe are being shared or misused.
5. Subscription Plans, Auto-Renewal & Billing
5.1 Subscription nature
Some Services are provided via paid subscription plans (e.g. monthly, weekly) and may include a free or discounted trial period.
When you purchase a subscription:
- You are purchasing ongoing access to Services for the duration of the subscription period.
- Unless you cancel in accordance with clause 5.3, your subscription will automatically renew at the end of each billing period.
5.2 Auto-renewal & recurring payments
By starting a paid subscription, you:
- Authorise OneWeekPTE (and our payment processors, e.g. Stripe, PayPal, App Store, Google Play) to charge you automatically using your chosen payment method at the then-current price at the start of each renewal period.
- Understand that charges will continue automatically until you cancel your subscription.
We will clearly display the subscription price, billing frequency, and whether auto-renew applies at the time of purchase.
5.3 Cancelling your subscription
You can cancel your subscription at any time by:
- Logging into your account and following the cancellation process; or
- Where applicable, using the subscription management tools of your app store (e.g. Apple App Store or Google Play Store).
When you cancel:
- Your subscription will remain active until the end of the current billing period.
- You will not be charged any further fees after the end of that period (unless you re-subscribe).
5.4 No refunds for subscription renewals (change of mind)
To the maximum extent permitted by law:
- We do not offer refunds or credits for:
- change of mind;
- forgetting to cancel before the renewal date;
- partial subscription periods (e.g. you cancel part way through a month); or
- unused access or features,
except where we are required to provide a refund under the Australian Consumer Law or other applicable laws.
6. Pricing & Changes to Plans
We may update subscription prices, features, and plans from time to time. Any changes to prices for existing subscriptions will be communicated to you in advance where required by law.
If you do not agree with a price or plan change, you may cancel your subscription before the change takes effect.
7. Refunds & Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law (ACL), including consumer guarantees that cannot be excluded.
Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. If the Services fail to meet a consumer guarantee, you may be entitled to a remedy such as a repair, resupply, refund or compensation, depending on the circumstances.
Aside from your rights under the ACL and other applicable laws:
- we generally do not offer refunds for subscription fees already paid; and
- any goodwill or discretionary refunds we provide do not limit your legal rights.
8. Educational Purpose & No Score Guarantee
The Platform is for educational and practice purposes only.
We do not guarantee:
- any particular PTE test score;
- visa or immigration outcomes;
- admission to any institution; or
- employment or other professional results.
Your results depend on many factors, including your starting level, effort, and official exam conditions.
9. Acceptable Use
You agree that you will not:
- Use the Platform for any unlawful or fraudulent purpose.
- Attempt to cheat in any official exam using our services or content.
- Copy, reproduce, resell, or redistribute our content, mock tests, or software, except as permitted under these Terms.
- Interfere with or disrupt the Platform, servers, or networks.
- Attempt to reverse engineer, decompile, or otherwise gain unauthorised access to our code or systems.
- Upload or share content that is illegal, harmful, abusive, harassing, defamatory, or violates the rights of others.
We may suspend or terminate your access if we reasonably believe you have breached this clause.
10. AI-Based Feedback & Limitations
Some features (such as speaking and writing feedback, scores, or suggestions) use artificial intelligence and third-party providers.
You understand and agree that:
- AI outputs are estimates and suggestions only.
- Scores and feedback may differ from official PTE results.
- You should use AI feedback as a study aid, not as a guarantee of real exam performance.
11. Intellectual Property
Unless otherwise indicated, all materials on the Platform are the intellectual property of OneWeekPTE or our licensors, including:
- text, questions, tasks, and solutions;
- mock tests and exam simulations;
- audio, video, and graphics;
- code, software, and databases;
- logos, branding, and interface design.
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial study.
You must not:
- copy, reproduce, or modify content except as allowed by law or with our written permission;
- use our content to create competing products or services.
12. User Content
If you upload or submit any content (including audio recordings, text answers, images, messages, or feedback):
- You retain ownership of your content.
- You grant OneWeekPTE a worldwide, royalty-free, non-exclusive licence to use, store, process, modify, and display that content:
- to provide the Services to you,
- to maintain and improve the Platform, and
- in anonymised or aggregated form for analytics and product improvement.
You confirm that:
- you have the right to upload the content; and
- your content does not infringe any third-party rights or break any laws.
13. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these Terms.
By using the Platform, you consent to our collection, use, and disclosure of your personal information as described in the Privacy Policy.
14. Third-Party Services & Links
The Platform may integrate or link to third-party services (e.g. payment gateways, analytics, cloud hosting, app stores, login providers).
We are not responsible for:
- the content, terms or privacy practices of third-party websites or services; or
- any loss or damage resulting from your use of third-party services.
Your use of those services is subject to their own terms and privacy policies.
15. Availability, Maintenance & Changes
We aim to provide reliable and continuous access to the Platform but do not guarantee uninterrupted or error-free service.
We may, at any time:
- modify, update, or improve the Platform;
- temporarily suspend access for maintenance or upgrades;
- remove or change features.
Where reasonable, we will try to minimise interruption and give notice of major changes.
16. Disclaimers
To the maximum extent permitted by law, and subject always to your non-excludable rights under the Australian Consumer Law:
- The Platform and Services are provided “as is” and “as available”.
- We do not guarantee that the content is always accurate, complete, or suitable for your particular circumstances.
- We do not guarantee that the Platform will be free from viruses or other harmful components.
17. Limitation of Liability
To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law:
- OneWeekPTE will not be liable for any indirect, incidental, special or consequential loss (including loss of profits, data, or opportunity) arising out of or in connection with the Platform.
- Where our liability cannot be excluded but may be limited, our total liability to you is limited to:
- the amount you paid to us for the Services in the 12 months prior to the event giving rise to the claim; or
- any lower amount required by law.
Nothing in these Terms is intended to exclude liability where it would be unlawful to do so.
18. Suspension & Termination
We may suspend or terminate your access to the Platform if:
- you breach these Terms;
- we are required to do so by law or a court; or
- we discontinue the Platform.
You may stop using the Platform at any time. Termination does not affect any rights or obligations that have already accrued.
19. Governing Law & Jurisdiction
These Terms are governed by the laws of New South Wales, Australia (or insert your state/territory). You submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth of Australia.
20. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, via email or in-app notice).
The updated Terms will apply from the “Effective date” shown at the top. By continuing to use the Platform after changes take effect, you agree to the updated Terms.
